2. Acceptance of these Terms

By accessing our website, requesting a free estimate, booking an appointment, or otherwise engaging our services, you agree to these Terms and to our Privacy Policy below. If you do not agree, do not use the site or submit information.

3. Estimates & Appointments

• Free estimates: Estimates are based on information observed at the time of the visit and are not binding. Final pricing may change due to conditions discovered during work, material changes, or scope changes.

• Scheduling: You can request an appointment via our online calendar or by phone. Booking is not confirmed until you receive a confirmation email or text from us.

• Rescheduling/Cancellation: Please notify us at least 24 hours in advance to reschedule or cancel. We may reschedule due to weather, safety, or availability.

• On‑site access & safety: You agree to provide safe access to the property and to secure pets/obstacles during the visit. We may decline or stop work if conditions are unsafe.

• Photos & documentation: With your permission, we may take photos/videos of the job site for estimating, quality assurance, or portfolio use. We will not publicly identify your address without consent.

4. User responsibilities

You agree not to: (a) submit false or misleading information; (b) attempt to disrupt the site or calendar; (c) infringe others’ rights; or (d) use the site for unlawful purposes.

5. Communication; SMS & Email Terms

• Transactional messages. By checking the consent box on our forms, you authorize us to send transactional emails and text messages (e.g., confirmations, updates, reminders) related to your request. Consent is not a condition of purchase.

• Message frequency. Typically 1–3 messages per appointment (booking confirmation and up to two reminders).

• Carrier & fees. Message and data rates may apply. Delivery is subject to your carrier’s network and device.

• Opt‑out. You can opt out of texts at any time by replying STOP; you may opt back in by replying START. For help, reply HELP or contact us at contact@ellisestates.net / (317) 854‑0003.

• Recordkeeping. We may log consent, opt‑outs, and delivery events for compliance.

6. Third‑party services

We may use reputable vendors to operate the website and send messages, including but not limited to: website hosting, analytics, email delivery, and SMS providers (e.g., Twilio). Each provider processes your information according to its own terms and privacy policies.

7. Calendars & iCal feed

If we provide a private iCal/ICS feed for your appointments, treat the feed URL as confidential. Anyone with the link may view appointment metadata. You can request revocation of a feed link at any time.

8. Intellectual property

The site and its contents (text, logos, images) are owned by us or licensed to us. You may not reproduce or redistribute site materials without written permission, except for personal, non‑commercial use.

9. Disclaimer of warranties

The site is provided “as is” and “as available.” We disclaim all warranties to the fullest extent permitted by law, including implied warranties of merchantability, fitness, and non‑infringement.

10. Limitation of liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the site or communications. Our aggregate liability will not exceed the greater of (i) $100 or (ii) amounts you paid us for the service at issue.

These Terms are governed by the laws of Indiana, without regard to conflict‑of‑law rules. Disputes will be resolved in the state or federal courts located in Owen County, Indiana. You consent to that jurisdiction and venue.
